1. Overview – Construction Contracts
o Unique nature of construction projects; Temporary Multi-Organisations (TMO)
o Key Performance Indicators (KPIs): Time, Cost, Quality, Safety, Environment, Communication, Claims, etc.
o Common contractual disputes
o No universal form but many forms of construction contracts
o Standard clauses in construction contracts such as Extension of Time (EOT), Variations, Liquidated and
Ascertained Damages (LAD), Suspension and Termination, Pay When Paid, and Dispute Resolution
2. Update – New Forms and Dispute Resolution Clauses
o Five-in-One Dispute Resolution Mechanism: Mediation, Adjudication, Independent Expert Certifier, Expert
Determination and Short-form Arbitration. Parties to construction contracts choose any one of the five dispute
resolution methods to resolve their dispute(s)
o Dispute Resolution Advisor (DRA); dispute prevention
o New standard construction contract for main contractors and sub-contractors being drafted
o NEC contracts for clients and main contractors; the partnering approach
