Steven Gallagher, Associate Professor in Practice of

Steven Gallagher was awarded a first class LL.B. He
was called to the Bar of England and Wales in 2006 by Gray’s Inn. Steven has taught Equity and Trusts, Land Law and
Company Law at undergraduate level and International Corporate Liquidation
and International Corporate Governance at masters’ level in England and Hong Kong.
Steven teaches the Equity and Trusts courses for undergraduate
students and the Principles of Equity and Trusts course on the Juris Doctor
course at the Chinese
University of Hong Kong. Steven’s research interests include equity
and the law of trusts, cultural heritage law and legal history, and he has
published articles on equity and the law of trusts, cultural heritage law,
and the law and the dead, and books on equity and the law of trusts and
business law. He is currently
researching into the origins of the law of trusts.

Course Objective:
This three hour seminar will consider the changes to
Hong Kong’s trust law that came into effect
on 1st December
2013. On 1 December 2013 the Trust Law (Amendment) Ordinance 2013 amended the Trustee Ordinance (Cap.29) and the Perpetuities and Accumulations Ordinance
(Cap. 257). Among the important amendments to Hong Kong’s trust law will
be the introduction of a statutory duty of care for trustees, changes to the
statutory powers of delegation of the trustee’s duties, the restriction of
exclusion of liability clauses by trustees, and the abolition of the rule
against perpetuities This seminar will consider the existing trust law in
these areas and the effect of the statutory changes.

Booking Terms
1. You may apply to
our course by sending to us (by fax/email followed by post) a duly completed
application form and a cheque in the sum of the relevant course fees. We will
confirm to you in writing via email or fax when your application is accepted
by us (“a booked course”).
2. If you cannot
attend a booked course, your written notification must be received by us 2
business days before the date of the booked course and you may either: a.
transfer your booking to a replacement delegate; or
b. transfer, up to 2 times, your booking to another course organized by us of
same value within 6 months of your
written notification. Otherwise the course fee paid will be forfeited. No
refund will be arranged in any event.

3. We may
reschedule, vary details of, cancel, or change/replace the speaker(s) of a
course, at any time without liability. If we cancel or reschedule the course
(with the exception of bad weather) a credit voucher will be issued or course
fees refunded
4. We reserve the
right to change the venue of the course at our absolute discretion
5. The course will
be cancelled if a No. 8 typhoon signal or black storm warning is raised
within 2.5 hours before the start of course
registration or during the course. In the event of cancellation due to bad
weather, the course may be rescheduled at our discretion, or a credit voucher
may be issued. No refund will be given.
6. You hereby
