Course Objective
The 3-hour seminar aims to provide the practitioners with update and practical tips on topical issues in the area of contentious probate and administration of estate in Hong Kong. Recent cases will also be discussed.

2. Issues arising from caveat proceedings
- Impact of probate action on caveat proceedings
- Issues arising when interests of minors are involved
3. Issues arising in proving Will and in probate action
- Construction of Will
- Proving knowledge and approval of contents of Will
-Application of 2nd rule of Barry v Butlin
- Costs issues
4. Issues arising during course of administration of estate
- Administrators/Executors’ duties and relief for breach of duties
- Duty to account and duty as to inventory of Estate
- Use of property during course of administration
5. Issues arising when distributing assets
- Proving life time gifts made by Deceased and donatio mortis causa
- Issues arising from special nature of family arrangement
- Trust property held by deceased
